I just got a message back from FXPro about my dispute over the -112pip loss during the disconnection. They are declining my claim because I didn't "call in". Well I have news for them, their website was down when I tried to find the number. I eventually found it in an email but couldn't get through when I called. FXPro is unbelievable and outrageous. They say I could have emailed, but that's not in the agreement. The bottom line is, they were unavailable and I lost money.

·Please note that in such cases the client has to follow the procedure specified under paragraph 5, of the Terms and Conditions, you have already accepted before submitting your application, which states that:
“The Company is not an Internet Service Provider nor is responsible for any electricity failures that prevents the use of the system and cannot be responsible for not fulfilling any obligations under this agreement because of the internet connection or electricity failures. In the case of such electricity / communication/ Internet failures, and the Client wishes to execute a position, then he must telephone our operators on the phone line + 357 (25) 969 239 and give a verbal instruction. The Company reserves the right to decline any verbal instruction in cases where its telephone recording system in not operational or in cases where the Company is not satisfied of the caller’s/Client’s identity or in cases where the transaction is complicated, and reserves the right to ask the client to give instructions by other means”.
Paragraph 5, of the Terms and Conditions, allows the clients to choose a different method of communication when there is a problem with internet connection and they wish to place an order, by calling 00357 (25) 969239.
Moreover in case telephone line + 357 (25) 969 239 is engaged, due to many people calling, Dealing Desk can accept these instructions by email, provided in the e-mail clear instructions for the closing/opening of positions are given, therefore the Dealing Desk had closed your position at the best price based on the time.
Finally please be informed that, it is a client’s obligation in case of any problems in opening/closing an order arise, to use the phone number in Paragraph 5 to place the desired order or as mentioned above to send an e-mail at Dealing Desk, giving precise orders of opening/closing positions. The different methods of communication, provided to our clients, should have been used by you immediately, in case of problems arising with Internet Connection.

Dude, F that. The power failure and internet outtages they're talkin' about in the " Terms and Conditions " only apply to outtages on your end - not their's. I suggest everyone stay away from them. That's BS. You had no control over your trade and it had nothing to do with you. It was all them. People tried calling them anyway but couldn't get to them, so how can they deny your claim ?

totally agree, I got the same nonsense from them also. luckily my trades came back into my range but i had to sweat it out... very unpleasant.

the problem i have is finding a non-shady broker at this point... who is everyone using?

I first got a reply that should have gone to another trader Nice protection of privacy - not! Then when they finally commented on my trade they of course declined it on the same grounds as you've all mentioned above. I've replied back that I'm not accepting that since the fault was solely at their end and that a better back up system should have been in place.

Considering their phone lines where blocked I say we have a very good case against them and suggest a joint action against them. My loss is too small in monetary terms to merit that I contact a solicitor on my own, but if there's a group of us with the same claim it shouldn't be hard to find a lawyer that will take it on.
Secondly we should definitely write a group statement to the regulators because the way they've handled this is totally out of line.

Let me know your thoughts.
